Comparison research between local work safety regulation and The Law of the People's Republic of China on Work Safety

In this paper the work safety regulations of 31 provinces and autonomous regions were collected,and every single term between local work safety regulation and The Law of the People's Republic of China on Work Safety was compared.From 8 aspects of safety concept,safety plan,supervision mode,organization and personnel,management system and method,safety expense,penalty and other,the representative and new statements or improved approach in local work safety regulations were summarized.On this basis,10 amendment advices were put forward,such as establish safety concept of people-oriented,bringcomprehensive treatment into safety production policy;make explicit requirements for the preparation of safety production planning,which will be incorporated into the plan for national economic and social development;define clearly the government consolidated supervision,industry management and other regulatory responsibilities;refine various types of enterprise safety management organization and staffing requirements;clear the legal status of Certified Safety Engineers,and in high-risk industries mandatory equipped with;clear labor dispatch personnel training duty,improve the personnel training system;Establish information system and credit system of safety production;clear expense payment and management requirements for the work-related injury insurance fund,Safety production risk mortgage and Liability insurance of safe production;increase punishment on accident potential behavior;incorporate it into The Law of the People's Republic of China on Work Safety investigating and managing for accident potential.
