On law relationship between universities and their students

By analyzing the theories about the law relationship between universities and their students of China and abroad,this paper considers that universities and their students have a special power relationship and an external administrative relationship according to public laws,and the two sides also have a civil legal relationship and an education contract relationship according to private laws.Since legal relationships are different,student rights relief systems are different from each other.According to universities' special legal positions and their different legal relationships with students,an ideal student right relief system should be established so as to protect both the autonomous administration power of universities and the legal rights of their students.
