Analysis and Outlook of Circulation Policies on Rural Collective Construction Land Tenure in China

The purpose of this study is to analyze and predict the circulation of collective-owned rural construction land,one of the key issues of rural land reforms in China. Methods of theoretical review and current situation analysis were employed. Based on the analysis on the background of rural collective construction land circulation policy,the relevant policies was summarized in six aspects :restrictions on circulation;value determination;revenue allocation;residential land marketing;commercial house marketing;and market direct entry. Three major problems are summarized as:the subject of land ownership is obscure and uncertain;the land use right is rigidly restricted and incomplete;the existing laws and regulations conflict against each other and lag behind practical requirements. In order to further promote and complete rural collective construction land tenure circulation,the following measures shall be taken:to clarify the tenure subjects and tenure range,to improve the land requisition policies,to establish the collective construction land evaluation system,to consolidate the land use control and unified land supply,to establish the financial system of rural land and registration system of rural collective land circulation,etc.
