Problems of Chinese Sports Law System

Sports legal system guided by the Sports Law of the People’s Republic of China has played an important role in the healthy development of China's sports undertakings.With the development of society,the problems existing in our sports legal system have become increasingly prominent.The controversy on sports concept has resulted in the missing of sports law concept,which has caused marginal fuzziness between the sports legal subjects.The present Sports Law has the basic characteristics of the Basic Law of sports.But its strong administrative law background reflects the legislative ideological tendency of power standard(management standard).It is desired that the Law may return to right standard when it is amended.It is a pity that sports arbitration system and institution building,featuring sports autonomy,are still missing.School sports legal system has not become the effective basis for solving school sports problems.The present sports legal system can not really protect sport rights.These basic issues directly affect the authority and effectiveness of our sports legal system.This paper just puts forward the problems and does not try to solve them.It aims to attract people’s attention to the problems so as to achieve the development and breakthrough of the construction of China’s sports legal system.
