Abstract
Establishing special criminal procedure becomes trend in development of criminal procedure all over the world. Summary procedure in Criminal Procedure Law of China does not provide standard of lowest justice to protect the defendant so that summary procedure can only apply with limit proportion. This does not satisfy the original intention to prescribe the summary procedure. Issues on establishing defendant participant mode to extend the scope of application of summary procedure should be analyzed and resolved under the base of standard of lowest justice.
