On the Protection of The Defendants' Rights in Summary Criminal Procedure

Abstract

Establishing special criminal procedure becomes atrend in development of criminal procedure all over the world. Summary procedure in criminal procedure law of China does not provide standard of lowest justice to protect the defendant so that summary procedure can only be applied with limited proportion. This does not satisfy the original intention to prescribe the summary procedure. So our country should perfect the procedural law in order to protect the rights of the defendants.
