Abstract

Criminal summary procedure reaches the simplification of litigation procedure on the basis of general procedure.The criminal procedure structure refers to procedural status and relationships of the prosecution,the defendant and the judgment.The procurator absents the prosecution in China's criminal summary procedure,which breaks the balance between the prosecution and the defendant.It would be perfected by reforming the procedure, establishing evidence discovery system and improving the right of the defendants.
