On the Establishment of Procedural Justice under Current Legislative Mode in China

Justice,characterized with fairness and rationality,is the most fundamental value human beings pursue forever.People have been pursuing procedural justice as well.In current research on procedural justice,however,scholars have only focused on how to reform systems from two perspectives: procedural operation and values of justice,which neglects the establishment of procedural justice from the angle of legislation.Research on procedural justice under current legislative mode aims,from the angle of legislation,to analysis the factors that might affect the procedural justice during the process of law-making,and probe into what influence the legislation might impinge upon the procedural justice,which helps to make a rational judgment about how to establish a justice law-making procedure.In this article,based on the concept of establishment of procedural justice under current legislative mode in China,the author has firstly tried to explain the legislation influence upon the procedural justice by analyzing the current situation of the establishment of procedural justice.And the author has also discussed about the issue from the value of judicature worker,the building of judicature workers and the construction of rule of law respectively.The author's purpose is to arouse people's awareness of the importance and necessity of the establishment of procedural justice under legislative mode.
