The administrative legislation plays very important role in China's legislation system.Along with the policy of administrating by law and ruling by law further strengthened,administrative legislation has taken an even greater importance.The legislation of China has the problems of subject missing constitutionality,aggravating of departmental legislation,the legislation capriciousness is big as well as the supervise system doesn't work well.Therefore,bridging of the constitutional status of administrative legislation,perfecting the procedures of administrative legislation and supervise system are some problems to be solved urgently in current administrative legislation.
