The Comparison and Enlightenment of State Compensation Systems

Abstract

In terms of the doctrine of liability fixation and scope of compensation,this paper introduces the state compensation systems of such countries and areas as Germany,France,Japan,South Korea,Taiwan and Macao.The paper then analyzes the deficiencies of China's State Compensation Law.To make China's state compensation system better,it is necessary to change the recognition way of the scope of administrative compensation and expand the scope of state compensation.It is suggested that the state compensation should cover the damages caused by the public facilities and all kinds of indirect damages,especially the spirit damage.
