The Environmental Administrative Enforcement and the Construction of Administration in Law and Order in China

A legal and rational environmental administrative enforcement is the prerequisite for constructing an administration in law and order,which in turn may be helpful for an orderly carrying out the environmental administrative enforcement.This paper first gave an analysis of such problems as no law to abide by,the subject′s absence of required voluntary rights of enforcement in environmental administrative enforcement,and unhealthy administrative responsibility mechanism in the process of constructing an administration in law and order.Then it put forward three relevant suggestions to improve the situation: the speed of legislation concerned should be quickened,the subject of environmental administrative enforcement should be endowed with voluntary rights of enforcement,and the legal responsibility should be consolidated in accordance with the reality of environmental administrative enforcement.
