On Development and Consummation of the Punitive Damages System in Our Country

The 2nd section of the 96th item in the Food Security Act of the People's Republic of China has stipulated the punitive indemnities for ten times of the food cost.Compared with the limitation tendency of the punitive damages in the USA,the punitive damamges in our country actually presents the expanded tendency.From the appearance of the punitive damamges system in the Consumer Rights and Interests Protection Act of 1993 for the first time,the suitable scope of the punitive damages system of our country expands day by day,the indemnity amount consummates gradually.However,there are still some problems in responsibility attribution principle,damages amount determination,application scope,etc..We should further consummate the responsibility principle of the punitive damages;expand the amount scope,and the application scope of the punitive cdamamges.
