Abstract
The current rural collective land system has many drawbacks, such as the subject of the land ownership misplaces, the ownership of land and its functions are incomplete, etc. Owing to these, farmers cannot fully utilize their land, and their interests cannot be gotten abundantly protection. Therefore, it become an important problem how to overcome the above-mentioned drawbacks and make the ownership system of the current rural collective land more scientific in the process of making the civil code of China.
