Abstract
The purpose of criminal law is not equal to the purpose of penalty because the before has higher value pursuing and ideal ambit than the latter. The punishing crimes should not be the purpose of criminal law because it is only action attribute of punishment itself. The viewpoint deserves discussing which stabilizing criterions is the realistic purpose during society revolution in China. Safeguarding human rights should be an important content of the purpose of criminal law.
