Discussion of Confucianism of Law in Ancient China through "Adjudicating Cases by Chunqiu"

Abstract

Confucianism of law is an important process in the development of ancient Chinese law.The penetration of Confucian thoughts towards the law affects the development orientation of Chinese law.During the mid Han Dynasty,with Confucianism achieving dominance,the orthodox legal thoughts with Confucianism as the mainstay came into being.Adjudicating Cases by Chunqiu is the beginning of the process.After that,with official recognition and the promotion by the great Confucianists,the Confucian legal thoughts were applied comprehensively in the ancient legislative and judicial circle.This paper presents Adjudicating Cases by Chunqiu,the process of Confucianism of law,and discusses how the contradiction between Confucianism and Hanfeizi's Legalism is solved.
