Abstract

The legal relationship between the school and the student is an important question that have drawn the attention of the academic circles. The author of this paper holds that the relationship between the school and the student is in essence a subordinate type of educational management and legal relationship. It differs both from the administrative legal relationship in its strict sense, and from the civil legal relationship. It has its own characteristics. The guardianship relation and the equal relation advanced by the academic and legal circles does not hold water at all.
