Abstract

The legal relation between the school and the student is an important question which have paid attention by the academic circles and legal practice.The author of this paper holds that the relation ship between the school and the student is in essence a special type of right and power in legal.In strict sense,it differs from both the administrative legal relationship,and the civil legal relationship and simple dual legal relationship.The school should respect the main body of the student right and safeguard it.
