Abstract
Legislation must follow the principle of legitimacy,which refers to the quality characteristics,such as the justice,morality and constitutionality.It is improper to understand the legitimacy of legislation as constitutionality or legality.The legality of legislation covers the validity of a number of characteristics,such as legislation,ethics,constitutional legitimacy,and the effectiveness.The legitimacy of legislation includes three major aspects: one is the legitimacy of the legislature;the second is the legitimacy of the legislative process;and the third is the legitimacy of content of legislation,and the outcome.
