Abstract
For the first time in history,the system of bankruptcy administrator was brought in by The PRC Enterprise Bankruptcy Law(Bankruptcy Law in short) which was taken effect in 2007.This system is of great importance to the perfection of legal system of our country,but due to the lacking of necessary corresponding specific judicial interpretations to the law,since the implementation of the Bankruptcy Law,there has been a divergence as to what is the proper status for the administrator to stand in to deal with all kinds of cases in the bankruptcy procedure both in theory and practice.So it is necessary to clarify the position of these bankruptcy administrators in the civil suits frequently appeared in the bankruptcy procedures.
