Review of the Articles Governing the Right of the Personality in the Propositional Draft of the Code of Civil Law of the People ' s Republic of China

The Law Research Institute of Chinese Academy of Social Science put forward the draft governing the right of the personality, which acknowledges the abstract right of the personality, deals with the effect and protection of the right of the personality, perfects types of the specific right of the personality and provides the extensive protection of the profit of the personality. The draft fully demonstrates the wisdom of the experts involved in drafting out the articles. On the other hand, because of subject model adopted and the limited length, the provisions are so simple that the draft does not acknowledge the right of personality of legal person, the principles of the exertion and protection of the right of personality and some significant specific right of personality and are not elaborate. It is eagerly expected that making full use of the essence in the draft to create a brand -new law of the right of personality in the human history.
