Supervising the Filing of Criminal Cases:Problems and Strategies

The supervision of criminal-case filing is the legal supervision of the legitimacy of public security authorities' acts in question on the part of the procuratorate.It is an important component of the latter's legal supervision of the procedure of criminal cases,which,together with the supervision of investigation,trial and execution,constitutes a complete system of criminal procedure supervision.However,the lack of legislative support and practicable criteria has made the supervision but a rubber stamp.A correct understanding of the problems therein is,therefore,of importance to perfecting the system of supervision for the filing of criminal cases in China.
