Suggestions for Improving China's Legal System of Product Liability

Abstract

In our country, there is no special regulation concerning product liability, which mostly stipulated in General Rule of the Civil Law of the PRC and Law of the People's Republic of China on Product Liability. Despite of the amending of Law of the PRC on Product Liability in 2000, which had promulgated in 1993, the currently practicing legal system on product liability remains many problems in forms and contents. Therefore, it is necessary to improve these issues in the aspects of blame charged principle of product liability, applied scope of product, intension of product defect and subject scope of product liability, etc.
