Abstract
In recent years, the opinions vary about the application of law to the settlement of the medical disputes. One is that the medical disputes should be settled in accordance with the administrative laws and regulations. The second opinion is that it should be settled by civil laws. The third is that the medical relation is an independent legal nexus, special rules and methods should be applied to the settlement of the medical disputes. Besides, the crime of malpractice and illegal medicine has been definitely prescribed in the criminal code of our country. The methods of how to settle the medical disputes will certainly be diversified with the deepening of reform on the medical system.
