Chinese criminal law regards the escaping behavior after traffic accident as a crime of accident to be punished more severely. It is a flaw in legislation and also brings much inconvenience in application. To make a compensation for this ,we must deal with it appropriately in practice and refer to other countries' rules and treat the behavior of escaping after traffic accident as an independent crime.
