The Legal Regulation of the Public Health Services from the Perspective of Market Background:Focusing on the Concept of Universal Service

The realization of the concept of universal service means that the public services are accessible in both quantity and quality,which largely depends on the state intervention.Public health services have the features of public interests,so the government shall play an essential role.But it does not mean that the market mechanisms and competition are to be excluded.Even though ordinary people are not satisfied with the medical reforms which have experienced continuous failures,concerning research in law field has not been started.The problems in public health services are caused by two factors,namely,the lacking of universal service concept and the failures of both the government and the market.The concept of universal service shall be applied in the new round of medical reform,in order to strengthen the duties and responsibilities of the government,and to establish and improve the legal systems.Thus the problems of market and government failures can be solved through regulations,and then,the rights to health may be guaranteed.
