Abstract

State mental compensation for damages has been a debate for a long time in academic circles.With the development of market economy and the strengthening of people's legal knowledge,the problems in law of state compensation for damages have gradually exposed.The perfection and development of the system of state compensation for damages are regarded as the surveyor's rod of democratic legality course.The paper begins with discussing the problems in implementing the system of state compensation for damages,puts forward the specific scope of state mental compensation for damages from the angle of law,and expounds the necessity and limitation of state mental compensation for damages.
