On the Establishment of Administrative Compensation System for Spiritual Damages

The draft of State Compensation Law Amendment has recently cleared the council for the first time by the National People's Congress. A key amendment of this draft is to specify the compensation for spiritual damages,which is an urgent issue in establishing the government's compensation system. Through case studies,this article has conducted an analysis of the missing of compensation for the relative person in the current compensation system,discussed about the necessity to establish the compensation system for the spiritual damages,and put forward some suggestions about how to establish the state compensation system for the spiritual damages in China.
