Abstract
For the reconstruction of China's traditional people mediation system, the first thing to be made clear is the function of the people mediation system, that is, a system resolving civil disputes through civil mediation. Knowing this point, the reconstruction of the people mediation should lay its emphasis on the strengthening of civil disputes solving function, including reconstructing the people mediation institute into professional legitimate institute of civil mediation, establishing the dual urban and rural mediation institute and system based on different conditions and demands of urban and rural conditions as well as building organic link between civil mediation and court judicial, so as to increase the efficacy of mediation contract.
