Abstract

The right to housing is a fundamental human right,which has both positive and negative characters.Posi-tive right to housing refers to the right to benefit that citizens enjoy under certain conditions to ask government to provide them with housing in keeping with their human dignity.Negative right to housing is the right that citizens enjoy to fight against the arbitary invasions of public rights.These are based on the human rights protection theory and the rights remedy theory.At the present stage,to protect the positive and negative rights to housing,especially the former one is of great practical significance.
