The Impact of the Drawbacks of the New Land Management Law on the Development of the Land Market

Abstract

This paper gives an adequate affirmation to the positive role the New Land Management Law plays in the development of the land market, and at the same time, analyses and discusses the problems and defects that, due to the drawbacks of the law itself, have gradually come into being during the implementation of the law. And to further perfect the land management law and the relevant laws and regulations, this paper, from the aspects of the land property right, the land supply, and the land income, puts forwards such approaches and countermeasures as specifying clearly the land property right and promoting the development of the market; strengthening the supervision of the land market, controlling the total supply of land, and standardizing the behavior of land sale; limiting strictly the range of the right to use the land that has been obtained by means of government allocation and prohibiting any of such obtained land from entering the market; perfecting the system of income by the sale of land and managing the price of land according to the market demand; and innovating the way of financing through the storing of land, standardizing the process of withdrawing the stored land, and controlling the city's price of land in a reasonable way.
