On Construction of Compensation System of Administrative Spiritual Tort——Let the Sun Warm the Hearts injured

The draft of State Compensation Law Amendment was considered finally by National People's Congress for the first time recently.From the draft,it can be seen that including compensation of administrative spiritual tort in administrative compensation system is one of the cores concerning State Compensation Law Amendment.Establishing and improving the system of administrative compensation for moral damage is a matter of urgency.In this paper,useing case study methods,the authors analyzed relief missing for victims because of the lack of today legislation of administrative compensation for moral damage,demonstrated essentiality of Establishing the system of administrative compensation for moral damage,and proposed some ideas about it finally.
