On Compensation for Spiritual Samage in State Compensation

Abstract
Whether the system of compensation for spiritual damage should be instituted in state compensation law has been a controversial focus in law circle.The article analysis and demonstrates the necessity of compensation for spiritual damage in Chinese state compensation law on the basis of the origin.The article also proposes the principles and provisions in our national system of compensation for spiritual damages compensation law which should be followed to,and some views in legislation and judicial practice 。
