Abstract
It is necessary to have a perfect legislation for anti-monopoly for the country in developing the socialist market economy. Based on its produce and the relationship with the administrative,the monopoly may be divided into two kinds,i.e. the economic monopoly and the administrative monopoly. And because of the peculiarity of the development in China抯 market economy,the administrative monopoly has posed a major danger for free and fair competition in market process. Therefore,it should be focused on the anti-administrative monopoly as the first constitution in the legislation for anti-monopoly in the coming years.
