Abstract
Administrative monopoly is the govemment's and government organs' behaviour to overuse administrative powers to impose restrictions on competition, including regional monoply, industrial monopoly, government's designating of transaction and the establishing of administrative companies. The influence of traditional planned economic system and imperfect interests mechanism are the main causes resulting in the occurrence and existence of administrative monopoly. Administrative monopoly is different from economic monopoly and its harmful effects are even worse. To struggle against the administrative monopoly, we need to accelerate the pace of legislating Anti-Monopoly Act in our country, construct the criteria of defining administrative monopoly, encompass administrative monopoly in the adjustment scope of Anti-monopoly Act and set up a special, relatively independent and authoritative enforcement organ so as to reach the goal of anti-administrative monopoly.
