An Analysis on Some Items of Road Safety Law

Abstract

The newly issued Road Safety Law has taken effect.There are lots of discussion on Article 76,which stipulates the rule for the determination of traffic accident happened between automobile and pedestrian.This paper attempts to do a legal-economic analysis on the value of strict liability and negligence liability by Costs-benefit theory,which is the fundamental of Legal and Economics in order to give a reasonable judgment to the legislation.
