Abstract
This paper agrees and insists that property shonld be a theory with strong explanatory power to demonstrate the necessity of community residents participation in ethnic villages' tourism,and the theory of property rights is necessary for the community involvement,the paper introduces the theory of human capital property rights,and accounts that intangible cultural resources such as national customs in ethnic villages internalize in the residents who are the activation vectors,rooting in the residents' thoughts and demeanor,and the property belongs to local residents naturally and is the human capital typically,and community residents participation in ethnic villages' tourism is the inherent requirement of human capital property rights' particularity.
