Judicial Review on Evaluating Professional Titles in Public Universities

The legitimacy of the involvement in review disputes on professional titles in public universities by judicial bodies derives from the facts that the review is of administrative behavior,also from the weak remedy for the educational complains and appeals,as well as from useful experience drawn from disputes between school and student.As to the review,it is necessary for court to review the evaluation of professional titles in public universities.The court should uphold limited review principle and legal review principle.Firstly;the court can quote general principles of administrative law to review the substantive legality of the evaluation.Secondly,the court can use the spirit of due process to review the procedural legality of the evaluation.The supreme people's court should pass special judicial interpretation to meet the requirements of educational trials before the modification of administrative litigation law.
