Nowadays,scholars in China contend about the problem of civil law standard.Comparatively speaking,representative views are theory of society standard of modern civil law,theory of right standard and society standard,etc.Society in the theory of civil law social standard can hardly find suitable load-bearing subjects of interests,therefore it can hardly be taken as the legislation standard and the standard value orientation.Civil law standard is the central task and value standard of civil law,indicating the fundamental guiding ideology and task.China's civil law should persist in private subject right standard and needn't give up its own private subject right standard as to adopt social standard.
