An Exploration of Views of Civil Law Standard

Nowadays scholars in China are having a heated discussion over the topic of civil law standard.Comparatively,representative views are the theory of society standard of modern civil law and the theory of right standard and society standard.“Society”in the theory of civil law social standard can hardly find suitable load-bearing subjects of interests;therefore it can hardly be taken as the legislation standard and the standard value orientation.Civil law standard is the central task and value standard of civil law,indicating the fundamental guiding ideology and task.Our country's civil law should stick to private subject right standard and need not give up its own private subject right standard so as to adopt social standard.
