The Study on the Case Scope of Sports Arbitration

The scope of sports arbitration means the scope which the sports arbitration institution accepts arbitration case.The statute of sports arbitration is being determined in our country,and defining the scope is the most important issue.Beginning with introducing overseas and the international legislation concerning the scope of sports arbitration,the author held that the sports arbitration scope in our country should be satisfied several conditions.Namely,the dispute must be occurred in competitive sports,and it must have arbitrate and must have the arbitration agreement or belong to the compulsion arbitration scope.According to these conditions,the scope of the sports arbitration includes the status disputes of the registration,the circulation and so on,the qualifications of the sportsman dispute,the disciplinary punishment dispute and the contract dispute in sports activities.But the dispute of referee's field and the sports administration dispute should be removed.
