Abstract
The retrial procedure distinguishes from others by its object of trial,the final jurisdiction.But it must obey the general law of the civil action taking litigants'right of action as the basis of procedure construction.The justice of the retrial procedure lies not in denying res judicata and procedure security, but in restricting them within a boundary.
