Abstract
The retrial procedure is distinguished from others by its object of trial which is the final jurisdiction. But it must obey the general law of the civil action taking litigants' right of action as the basis of procedure con-straction. The justice of the retrial procedure lies not in denying resjudicata and procedure security, but in restricting them within a boundary.
