Abstract
Real estate investment trusts (REITs) is a real-estate financing instrument prevailing abroad. In essence, they are a type of securitized industrial investment fund, with features and advantages unparalleled in other investment instruments. However, the introduction of REITs in China will be confronted with legal difficulties in such aspects as real estate law, trust law, securities law and company law. In the legal regulation of REITs, we should not only improve related legal system, but also introduce specific legislation, establishing a legal system of REITs suited to China’s needs.
