Judicial activism and restraint doctrine are the judicial activities of judges in the judicial philosophy model.Judicial restraint doctrine demonstrates the intention of the rule of law and respect,and the law has been considerably intelligible,predictable and widely respected Judicial activism is demonstrated by the pursuit of possible cases of justice,and has been under the attention of many supporters,so fierce collision of these two models traps judges.In our country,judges should uphold a mild judicial philosophy of activism to better the rule of law and pursue for justice.
