Under the condition of market economy,the position of market corpus should be equal,and the environment of the competition should be fair.However,the administrative monopoly,affected by the planned economy in our country,has not only hindered the development of the market economy,but more important it has not accommodated itself to international economic integration.The paper analyzes the forms,harms and causes of the administrative monopoly,and points out the imperfection of the administrative monopoly in lawmaking system,and illustrates the way of perfecting legally,especially in administrative legislation,the system of the administrative monopoly.
