Abstract
Public interest is one of important concepts of Chinese intellectual property law. Its function can be divided into three aspects: negative function, positive function, and punitive function. The concept is not interpreted by legislation, but by theoretical study. The contents of this concept involve politics, economy, and ethics. The use of this concept in intellectual property law of China should be improved.
