Abstract

The purpose of this paper is to discuss the feasibility for wide implementation of the post-disaster policy on transfer of rural residential land use right in Chengdu City(i.e.,after Wenchuan Earthquake) in order to provide references for institutional reform on rural residential land use right transfer in the whole China.Methods of literature analysis,comparative analysis and logical analysis were employed.The results indicated that under the premise of ensuring the living conditions of farmers,the policy of free transfer of the rural residential land use right to any third party is in accordance with laws and is feasible to be widely implemented.However,the free transfer institution should be supplemented with three additional institutions,which are unified property recognition of rural residential land use right,settled contractual periods of the land use right,and compensated transfer of land use rights.It is concluded that under certain constraint conditions,the free transfer of rural residential land use right to any third party could be a good start for current reform on rural residential land use right.
