Reviewing and Analyzing of Environmental Criminal Law Judicial Interpretation

Abstract

The environmental criminal law judicial interpretation is very important in protecting environmental rights and plays important role in judicial practice.But there exists some shortcoming in the environmental criminal law judicial Interpretation,such as neglecting ecological function of environmental element,ignoring the environmental criminal procedure and criminal preventing,and Judicial interpretation technology trending judicial conservatism extremely.For the purpose of effective punishment of environmental criminal and exerting the function of Environmental criminal law,we should perfect Judicial Interpretation through enhancing the protection of ecological function,emphasizing the procedure constructing and criminal preventing,and improving the judicial interpretation technology.
