Formation Right of the Government Information and the Obligation of the Party

Behind the issue of public access of government information,there is an important problem,that is the resource and collection of government information. The government has the formation right of information of which the basis is the requirement of correct information,the construction of credit society,the protection of individual rights and the regulation of public good. By this right,the government has the power to citizens and legal persons on compulsory submitting,keeping,disclosure information,as well as investigating,filing and sustaining information,the utilization of information technology,obtaining budget support and sanction on illegal collection of information. Such rights and powers levy burden and duty on relative parties,it is necessary to deal with the public power of government and the individual rights in a balanced way.
