An Inspection and Actual State Analysis of China's Rural Land System Changes in the Perspective of Property Rights

Abstract

The rural land system has always been a key to China's rural reform,whose theme lies in property rights.Therefore,the key to the current rural land system reform rests with establishing a rural land property rights system geared to China's social and economic development by using the modern theory of property rights to define and arrange the rural land property rights reasonably.By inspecting changes in the rural land property rights system since the founding of New China and analyzing its actual situation,this paper opines that the implementation of the rural land property rights system with the state enjoying the ultimate ownership of the rural land and the farmers having the permanent right for its utilization is fairly appropriate;for one thing,the state can enjoy more effective ultimate control power and umpirage on rural land than simple legal regulation;and for another,the farmers are able to secure the subprivatization land property right conducive to best mobilizing their own initiative and enthusiasm.Such a rural land system can promote benefits and abolish harms as well as be beneficial to both the state and the farmers.
